4. Prohibited Content

• Illegal Content: Content that is illegal or promotes illegal activities, such as violence, drug use, copyright infringement or illegal downloads, is strictly prohibited.
• Harmful Content: Content that promotes self-harm, harassment, bullying, hate speech, or discrimination is not allowed.
• Infringing Content: Uploading content that infringes on the intellectual property rights of others, such as copyrighted material without permission, is prohibited.
• Malicious Content: Content that includes malware, viruses, or any harmful software is strictly prohibited.

Sensitive Data: Users must not upload content that contains sensitive personal information, such as financial details, identification numbers, or other confidential data without proper authorisation from the individual or entity to whom the data belongs.. Users must comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable, when uploading personal or sensitive data. Cinema8 is not responsible for verifying compliance with such laws.

5. User Responsibilities

• Compliance: Users must comply with all applicable laws in England and Wales, and Cinema8 policies when creating and uploading content. Users must also ensure that their content complies with the laws of their local jurisdiction, including but not limited to copyright, data protection, and privacy laws.
• Accuracy: Users must ensure that their content is accurate, truthful, and not misleading.
• Respect for Privacy: Users must respect the privacy of others and not upload content that may invade another person's privacy, without their explicit prior and written consent.
• User Responsibility for Permissions: If the content includes third-party materials (such as images, videos, or music), users must ensure they have obtained all necessary rights, licences, and permissions for use. Cinema8 will not be held responsible for users' failure to acquire such permissions.

6. Cinema8's Response to Copyright Claims

Cinema8 respects and responds to copyright and intellectual property laws in all jurisdictions where our platform is accessible. We will take prompt action to address copyright infringement claims that are properly submitted to us. Cinema8 is not responsible for verifying third-party permissions, and users are solely responsible for acquiring all rights and licenses necessary for the content they upload.

7. Consequences for Violations

• Content Removal: Cinema8 reserves the right to remove any content that violates this Policy with or without prior notice. In cases where immediate action is necessary to protect the platform or its users, content may be removed or accounts may be suspended without notice at Cinema8's sole discretion.
• Account Suspension: Users who repeatedly violate this Policy may have their accounts suspended or terminated. No refunds will be given by Cinema8 to the user upon account suspension or termination due to violation of this Policy. In the event of suspension or termination due to violations, users will forfeit any rights to a refund of fees paid to Cinema8.
• Legal Action: In cases of severe violations, Cinema8 may take legal action against the offending user. Users violating Cinema8's intellectual property rights may face legal action, including claims for damages and litigation costs.

8. Content Review Process

• Automated Monitoring: Cinema8 uses automated tools to monitor and flag potentially violating content. These tools include AI-driven systems designed to detect content violations based on preset parameters, but users are still responsible for compliance. Users still remain responsible for ensuring their content complies with this Policy, and Cinema8 does not guarantee that all violations will be detected by automated systems.
• Manual Review: Flagged content will be reviewed by human moderators to determine if it violates this Policy.

9. User Reporting

• Reporting Mechanism: Users can report content they believe violates this Policy through the reporting feature on the Cinema8 platform. Additionally, Cinema8 shall not be liable for indirect, incidental, or consequential damages, including data loss, service interruptions, or reputational harm, except where prohibited by law.

11. Indemnification

Users agree to indemnify and hold Cinema8 harmless from any claims, damages, or expenses arising from their content or use of the Cinema8 platform. This indemnification applies to claims, damages, or expenses arising under the laws of any applicable jurisdiction, including but not limited to intellectual property violations or data protection breaches.

12. Changes to This Policy

We may update this Policy from time to time. We will notify you of any changes by posting the new Policy on this page and updating the "Last Updated" date at the top of the document.
